ATTENTION PESTICIDE DEALERS:
REGULATION PASSED REQUIRING
SALES RECORDS KEPT FOR ALL RUP'S
On October 2, 2001, the North Carolina Pesticide Board unanimously passed an emergency regulation requiring dealers to keep sales records for all restricted use pesticides. Adoption of the regulation by the Board was in response to the terrorist activities of September 11, 2001. Both the N.C. Crop Protection Association and the N.C. Farm Bureau gave full support to this regulation, which will become effective November 1, 2001.
Since invoices of pesticide sales will suffice for meeting the requirements of the regulation, this action by the Board should have minimal impact on your current activities. There are 10 elements that will need to be documented for each restricted use pesticide sale. You must also verify the identity of the purchaser. Verification means that the seller shall assure that the purchaser is a currently licensed or certified applicator and that the cardholder is the person named on the card. There is one exception to this requirement. The regulation allows an employee of a certified or licensed applicator to receive restricted use pesticides, provided all 10 elements are documented and the recipient, who must be at least 16 years of age, signs for these pesticides.
The 10 elements that are required by the emergency regulation are:
- Date of sale;
- Initials of sales clerk;
- Name of certified or licensed applicator;
- Certification or license number from card;
- Expiration date as shown on the card;
- Product brand name;
- EPA registration number;
- Number of individual containers;
- Size of individual containers;
- Total quantity sold.
If you are suspicious of someone who wants to purchase restricted use pesticides, report this to your local authorities. Some activities that should raise awareness are: out of season sales, unusual request for pesticides, someone previously unknown to be in the business of applying pesticides.
