Wholesale and Retail Frozen Desserts

The Food & Drug Protection Division is responsible for the regulatory oversight of wholesale and retail frozen dessert manufacturers operating within the State. Presently, the operations are defined as follows including the appropriate license fee:

    (a) "Wholesale Frozen Dessert Manufacturer" means any owner or operator of an establishment where frozen desserts are made or stored for disposal at wholesale to retail dealers for resale in this State. License/certificate fee is $40.00.

     (b) "Retail Frozen Dessert Manufacturer" means any owner, operator or proprietor of a retail frozen dessert dispenser or a mobile frozen dessert manufacturing unit. License/certificate fee is $10.00.

    (c) "Retail Frozen Dessert Dispenser" means any device that dispenses a frozen dessert at retail. License/certificate fee is $10.00. Note: This does not include the conventional spindle-type milk shake mixers, but does include other dispenser milk shake machines.

    (d) "Mobile Frozen Dessert Manufacturing Unit" means a retail frozen dessert dispenser that is mounted on or connected to any vehicle from which frozen desserts are sold. License/certificate fee is $10.00.

    (e) "Wholesale Cheese Manufacturer" means any owner or operator of an establishment where cheese is produced for distribution at wholesale to retail dealers for resale in this State. License/certificate fee is $40.00.

    (f) "Retail Cheese Manufacturer" means any owner or operator of an establishment where cheese is produced for distribution at retail only in this State. License/certificate fee is $40.00.

(g) "Wholesale Butter Processing Manufacturer" means any owner or operator of an establishment where butter is manufactured or processed for distribution at wholesale to retail dealers for resale in this State. License/certificate fee is $40.00.
 
A person shall not operate as a wholesale or retail frozen dessert manufacturer, a wholesale or retail cheese manufacturer, or as a wholesale butter processing manufacturer without first obtaining an inspection certificate issued by the Commissioner of the North Carolina Department of Agriculture. A license/certificate is issued on a yearly basis from July 1 to June 30 of the next year. These operations are inspected at scheduled intervals and samples are collected by representatives of our Department for analysis.
